New federal restrictions capping total THC at 0.4 mg per container are scheduled to take effect this fall. A report from cannabis law firm Vicente LLP summarized the uncertainty this way: “With the November 12, 2026, deadline now less than six months away, the window for legislative intervention is narrowing fast, and the path forward remains anything but certain. Rectifying the ban through the 2026 Farm Bill is unlikely, and the standalone bills most likely to provide relief still face an uphill climb in a divided and distracted Congress.”
Ultimately, the industry’s future may depend on state legislation. “Some state lawmakers are moving quickly to pass legislation to preserve state-level hemp markets,” says the Vicente report, “while others are taking steps to align their jurisdictions with the impending federal restrictions.” Illinois Gov. J.B. Pritzker passed SB3222 in June, which will tighten restrictions on all intoxicating hemp products except beverages, come November.
